Stratford District Councillor Graham Kelly is yet to apologise for breaching the council's code of conduct earlier in the year.
Councillor Kelly was censured in May after an investigation revealed he had committed multiple breaches of confidentiality by phoning candidates for the vacant chief executive role.
A council report dated May 1, which was released to the Stratford Press under the Official Information Act, recommended Councillor Kelly be asked to write an apology to council. Councillors at the meeting voted in favour of the recommendation.
At the same meeting, Councillor Kelly was suspended from his roles on the executive committee and the policy and services committee.
Independent investigators Hammond Robertson were called in after complaints were made against Councillor Kelly.
A subsequent report found he discussed confidential candidate details with at least one customer at his hair salon.
The independent investigation concluded there were multiple breaches of confidentiality by Councillor Kelly during the employment process of the chief executive in February 2017.
During the Stratford District Council Policy and Services Committee meeting question time last Tuesday, councillor John Sandford asked whether councillor Kelly had apologised to council.
Councillor Kelly was not at the meeting, so chairman Alan Jamieson said he would try and get an answer from councillor Kelly.
Chief executive Sven Hanne said the council had not received an apology to his knowledge. Mayor Neil Volzke said he also had no knowledge of receiving an apology.
Councillor Sandford followed up with a second question regarding legal action.
"He threatened us with legal action, is it going to happen or will it hang over our heads?"
Again, both the mayor and the CEO said they had not heard.
Councillor Kelly told the Stratford Press said he had written an apology but wanted to meet with the mayor in private before submitting it to the council. He declined to comment about potential legal action.
He said he didn't attend the meeting because he hadn't received an agenda, despite asking for one.
"It wasn't forthcoming so I didn't think it was worthwhile going without having an understanding of what was in [the agenda]."
Mr Hanne said councillor Kelly was no longer on the Policy and Services Committee and as a result did not receive an advanced copy of the agenda. The date and time of the meeting was on the meeting schedule, which has been distributed to all councillors and was also available on the council's website.
"As per the provisions of the Local Government Act, Councillor Kelly is still able to attend the meetings of this committee and participate in any discussion, he would however not be able to cast a vote."
Mr Hanne said agendas were available to elected members on arrival at meetings.
